GetMoving! General Terms of Use


Last updated October 16, 2013. Replaces the May 7, 2012 version in its entirety.

1. Your agreement with GetMoving!


1.1. Choice of Law. If you are a resident of Western Europe, your relationship is with GetMoving!, a French company, and you agree to be bound by the laws of France and the laws of the European Union. If you reside outside of Europe, your relationship is with GetMoving! Incorporated, and you agree to be bound by the laws of California


1.2. GetMoving! may change the Terms at its sole discretion. If we change the Terms, then we will make a new copy available at http://www.getmoving.com. Your use of the Services is subject to the most current version of the Terms at the time of such use.


2. Definitions.


Unless otherwise defined, capitalized terms used throughout these General Terms have the meanings stated below:
2.1 “Account Information” means the information you provide to GetMoving! when you register for a service, including your ID and log-in information.
2.2 “Intellectual Property Rights” means copyright, moral rights, trademark, trade dress, patent, trade secret, unfair competition, etc.
2.3 “Law” means any applicable law, regulation, or generally accepted practices or guidelines in any applicable jurisdiction, such as any laws regarding the export of data or software to and from the European Union or other applicable countries.
2.4 “Marks” means the trademarks, logos and service marks displayed on the Services.
2.5 “Share” means to email, post, transmit, upload, or otherwise make available through your use of the Services.
2.6 “User” means a user of the Service.
2.7 “User Material” means (a) Your Material and (b) Shared Material uploaded by other Users.


3. Acceptance of Terms.


3.1 You may not use the Services if you do not agree to the Terms. By clicking "Sign up", you confirm that you have read this document and you accept the above-stated conditions.


3.2 GetMoving! may require you to provide consent to the updated Terms before further use of the Services is permitted. Otherwise, your continual use of any Service constitutes your acceptance of the changes.
